Mr. Mayank Joshi, learned legal aid counsel for the applicant.
2. Mr. Bhaskar Chandra Joshi, learned AGA assisted by Mr. Vikas Singh Uniyal, learned Brief Holder for the State.
3. Present bail application has been moved on behalf of the applicant. The applicant is in judicial custody in connection with FIR/Case Crime No.58 of 2023 for the offence punishable under Sections 8/22 of The Narcotic Drugs and Psychotropic Substances Act, 1985 (for short the N.D.P.S. Act) registered at Police Station Rudrapur, District Udham Singh Nagar.
4. Heard Mr. Mayank Joshi, learned legal aid counsel for the applicant and Mr. Bhaskar Chandra Joshi, learned AGA for the State of Uttarakhand.

The State’s case, as gleaned from the recovery memo and FIR, is that on the night of 24.01.2023 at approximately 23:05 hours, a police team led by Sub-Inspector Mohan Chandra Joshi was conducting routine patrol duty and surveillance near Kichha Road, Paharganj, Rampura, in an attempt to curb the sale and consumption of illegal drugs.
6. It is alleged that the applicant-Anand Sharma, and one co-accused, Sukhveer Singh, were observed walking from Rudrapur towards Paharganj while each was carrying a black foil packet in hand.
7. Upon being questioned, the two individuals were unable to provide any satisfactory reason for their late-night presence or for the possession of the said packets.
8. Upon inspection, the police allegedly recovered from each of the accused: 25

Learned counsel for the applicant submits that co-accused-Sukhveer Singh has already been enlarged on bail by this Court vide order dated 15.04.2025 in the similar offence, thus on the ground of parity applicant is also entitled to be enlarged on bail.
10. Learned State Counsel has not opposed the bail application.
11. After hearing the learned counsel for the parties, on perusal of the record and without going into the merits of the case, this Court is of the opinion the applicant be released on bail.
12. Accordingly, the bail application is allowed. Let the applicant-Anand Sharma be released on bail on his furnishing a personal bond and two sureties of the like amount to the satisfaction of court concerned. The applicant shall cooperate with the investigation and shall not directly or indirectly make any inducement, thereat, or promise to any person acquainted with the facts of the case.
