Heard Sri Gandham Raghavendra Pavan, learned counsel for petitioner, learned Government Pleader for Services - I representing on behalf of respondents 1 and 2, Sri M.S.R.Chandra Murthy, learned standing counsel for MGNREGS, representing on behalf of respondents 3 and 4 and I Smt.B.V.Aparna Lakshmi, learned standing counsel, representing on behalf of 5*^ respondent. 3. Petitioner has been appointed as Field Assistant of Nelaballi Gram Panchayat in the year 2006 on contract basis and worked as such till October, 2024. Thereafter, 3^'^ respondent vide proceedings dated 07.10.2024, placed the petitioner under suspension based on the allegation that the petitioner committed I misappropriation of funds and sought an explanation from the petitioner in that regard. Pursuant thereto, the petitioner submitted his Explanation refuting the allegations made against him and pleaded to drop the proceedings. Thereafter, petitioner filed the present writ petition challenging the impugned suspension order. 3 CGRJ W.P, No.6072 of 2025 Learned Standing Counsel for MGNREGS appearing for respondents 3 and 4 submits that aftor the suspension order, based on the preliminary enquiry report submitted by the 4*^ respondent dated 02.10.2024, final enquiry was initiated against the petitioner and same is going on and soon the respondents would conclude the same and seeks one month time to complete the said exercise. 4.
As the enquiry itself is slatted and the petitioner has already submitted an explanation, this writ petition is disposed of directing the 3'"'^ respondent to complete the ongoing enquiry within thirty days from the date of receipt of a copy of this order and pass appropriate orders in accordance with law. Petitioner shall be permitted to submit further explanation, if any, on the date of enquiry and upon considering the said explanation, the 3'’^ respondent shall pass orders. No costs. 5. As a sequel, miscellaneous petitions pending
consideration, if any, in this case shall stand closed.
