GP FOR REGISTRATION AND STAMPS The Court made the following: ORDER: This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “to issue an order direction writ more particularly Writ of Mandamus declaring the action of the 2nd respondent in not deleting the land in Sy.No.532-4 to an extent of Ac.5-90 cents situated at Pothapolu Village, Madanapalle Mandal, Annamayya District and consequently direct the 2nd respondent to delete the land in Sy.No.5324 to an extent of Ac.5-90 cents situated at Pothapolu Village, Madanapalle Mandal, Annamayya District from the prohibitory properties list under Section 22-A of the Registration Act by considering the report submitted by the 4th Respondent and to pass such other order or orders...” 2. Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. 3. The learned counsel for the petitioner submits that the petitioner is the absolute owner and possessor of land in Sy.No.532-4,ad measuring Ac.5-90 cents, situated at Pothapolu village, Madanapalle Mandal, Annamayya district having acquired the said land through a registered sale deed dated 16.08.2012, and since then the petitioner has been cultivating the said land and also the 4th respondent (revenue authorities) issued pattadar passbook and title deed in favor of the petitioner. On 20.02.2024, the petitioner submitted an application through Mee-Seva to the 4th respondent, seeking the deletion of the said land from the prohibited properties list. In pursuance of the application of the petitioner, the 4th respondent directed the (Mandal Revenue Inspector)/Tahsildar to conduct an enquiry. After a detailed inquiry, the inspector submitted a report on 03.07.2024, confirming that the land is classified as patta land in the revenue records. Based on this, the 4th respondent recommended to the 2nd respondent that the land be deleted from the prohibited properties list. However, despite the recommendation made by the 4th respondent, the 2nd respondent has not taken any action. Hence, this writ petition. 4. The Learned counsel for the petitioner submits that it will suffice if a direction is given to respondent authorities to consider the representation dated 01.08.2024 submitted by the petitioner, in accordance with the law. 5. The learned Government Pleader for Revenue, appearing for the respondents, submits that pursuant to the report submitted by the Mandal Revenue Inspector, if the subject land is classified as patta land and is recorded in the revenue records and the petitioner has also been issued a pattadar passbook and title deed. Hence, the respondent authorities will consider the petitioner’s representation dated 01.08.2024 in accordance with the law within a reasonable time. 6. Having regard to the submissions made by learned counsel for the petitioner and learned Government Pleader for the respondents, in view of the facts and circumstances of the case, without going into merits of the case, this Court is of the considered view that the present Writ Petition can be disposed of, by directing the 2nd respondent to consider the representation of the petitioner dated 01.08.2024 and pass appropriate orders within a period of three (03) months from the date of receipt of a copy of the said representation. 7. With the above said direction, the Writ Petition is disposed of. There shall be no order as to costs.
