(Oral) By way of instant petition, petitioner has prayed for following main reliefs:-
“i. That respondents may kindly be directed to consider the case of petitioner for granting the two additional increments on completion of 20 years of service as per notification dated 10.09.2015 (Annexure P-1) as well as orders of this Hon’ble High Court which has been upheld by the Apex Court. ii. Those respondents may kindly be directed to consider and decide the representation (Annexure P-4) of the petitioner accordance with law.”
2. Before the reply could be received on behalf of the respondents, learned counsel representing the petitioner, on instructions, states that his client would be content and satisfied in case his pending representation dated 20.01.2025 (Annexure P-4 ) is
considered and decided by the competent authority in light of
judgment rendered by Division Bench of this Court in CWP No.4167 of 2019, in case titled Himachal Road Transport Corporation Vs. Suresh Kumar & Ors., in a time bound manner
3. Having regard to the nature of prayer made in the instant petition and order proposed to be passed, this Court sees no necessity to call for the reply on behalf of the respondents, who are otherwise represented by Mr. Deepak Sharma, learned Counsel, who while accepting notice on behalf of the respondents, fairly states that pending representation, if any, filed by the petitioner shall be decided expeditiously in accordance with law.

Having perused the averments contained in the present petition which is duly supported by an affidavit as well documents annexed therewith vis-a-vis judgment sought to relied upon, this Court is convinced that issue sought to be decided in the proceedings already stands adjudicated by this Court in judgment detailed above and as such, no prejudice would be caused to either to the parties in case innocuous payer made by the petitioner, as taken note hereinabove is accepted.
5. Consequently, in view of the above, the present petition is
disposed of with a direction to the respondents to consider and decide the pending representation dated 20.01.2025 (Annexure P-4) of the 2
petitioner expeditiously, preferably within a period of six weeks. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of hearing to the petitioner and pass detailed speaking order thereupon taking note of the judgment rendered by Division Bench of this Court in HRTC (supra), wherein issue otherwise sought to be decided in the instant proceedings already stands adjudicated.
