Page No. 1 / 4 https://www.mhc.tn.gov.in/judis W.P.No.34309 of 2025 For petitioner : Mr.V.Ajoy Khose For respondent: Mr.C.Gowthamaraj, Standing Counsel ORDER The petitioner has filed the present Writ Petition seeking to issue a Writ of Mandamus to direct the respondent to pay the petitioner interest at the rate of 18% per annum, for the period of delay from 01.07.2023 to 15.04.2025, in paying the amounts paid towards his terminal benefits, namely EPF Employee's Contribution, Gratuity and for the period of delay from 01.07.2023 to 20.04.2025, in paying the amounts paid towards his terminal benefits, namely encashment of Leave/already surrendered earned leave, within a time frame as may be fixed by this Court and without affecting his right to claim balance amounts towards those benefits. 2. The petitioner was appointed/working as Tradesman in the respondent- Corporation from 01.09.1985. After completion of 38 years of service and finally working as Tradesman with Staff No.85TH1012297 in the respondent- Corporation, he retired from service on 30.06.2023 on reaching the age of superannuation. But only after passing of 1.5 years, he has been paid the terminal benefits, without interest for the delayed payment of the same. Hence, the petitioner is forced to approach this Court praying direction to the respondent to pay the interest amounts. Page No. 2 / 4 https://www.mhc.tn.gov.in/judis W.P.No.34309 of 2025 3. Heard both sides and perused the materials available on record. 4. Taking into consideration the facts and circumstances of the case, a direction is issued to the respondent to determine the eligible benefits payable to the petitioner and after determining that particular amount, to pay the same to the petitioner together with interest @ 6% per annum from the date on which the petitioner had retired from service, till the date of actual disbursement of the amounts. 5. With the above direction, this Writ Petition stands disposed of.
