Sri Arvind Yadav, learned counsel for the applicant-wife submits that the application for maintenance has initially been moved under section 125 Cr.P.C. for the applicant and her daughter on 26.09.2022. On 04.03.2023 her daughter (applicant no.2) passed away. The opposite party no.2 has put in appearance on 15.01.2025, but till date the application under Section 125 Cr.P.C. has not been disposed of. The applicant is a house wife, who entered into marriage with opposite party no.2 on 12.05.2014. The atrocities began after the birth of girl child on 29.01.2019. The applicant was finally thrown out from her matrimonial house on 05.11.2020. The innocuous prayer of the applicant is for disposal of her application at an early date, as such he seeks interference of this Court. 2. Learned AGA for the State. 3. There is no point in issuing notice to opposite party no.2, as the innocuous prayer of the applicant is to expedite the disposal of her application moved under Section 125 Cr.P.C. 4. This Court has taken into consideration the rival submission made by the parties and is of the view that the Application No. Versus Counsel for Applicant(s) : Arvind Yadav Counsel for Opposite Party(s) : G.A. Sadhna And Another .....Applicant(s) State of U.P. and Another .....Opposite Party(s) 1055 of 2022 ( Sadhna Vs. Santosh ) pending in the court of Principal Judge, Family Court, Gorakhpur may be expedited and disposed of at an early date. 5. The application is accordingly, disposed of.
