GP FOR WOMEN DEV CHILD WELFARE(AP) The Court made the following: ORDER: Heard Sri N.Ranga Reddy, learned counsel for the petitioner, learned Government Pleader for Women Development and Child Welfare, appearing for the respondents 1 to 3 and Ms. Gouthami Surapareddy, learned counsel for the 4th respondent. 2. Learned counsel for the petitioner would submit that the petitioner has applied for the post of Anganwadi Worker. She was not selected. Respondent No.4, who has no required qualification of 10th class, she was 3 selected as Anganwadi Worker. Challenging the same, the present writ petition is filed. 3. Learned counsel for respondent No.4 would submit that pursuant to the notification dated 16.02.2006, the interviews were held on 04.12.2006. By the date of the notification, respondent No.4 passed 8th class. But, subsequently she could secure 10th class in the year 2010. 4. Learned Government Pleader for Women Development and Child Welfare, would submit that the Department has followed the procedure in the light of the Circular Memo No.20888/K3/94, dated 09.02.1995. Learned Government Pleader would submit that the petition is devoid of merits and prays for dismissal of the petition. 5. For ready reference, it is relevant to extract para 3 of the said Circular Memo, which reads as under: “3. To the extent possible, effort should be made to select a person with 10th class education from the same village. In the case of villagers where local women with 10th class education are not available the qualification may be relaxed to 9th, 8th and so on. It must be noted that even an illiterate local candidate can be selected instead of an educated non-local person.......” 6. Considering the submissions made and a perusal of material on record, it appears that as on the date of the selection for the post of Anganwadi Worker, respondent No.4 passed 8th class and that the education qualification 4 can be relaxed when local candidate with 10th class is not available. In the light of the same, the writ petition deserves dismissal. 7. In the result, the Writ Petition is dismissed. There shall be no order as to costs.
