Writ petition OWP No. 699/2012 preferred by three petitioners came to be disposed of by the writ court in terms of judgment dated 29.05.2023 with a mandamus issued unto the respondents to initiate the requisite acquisition process under the relevant provision of law so as to result in payment of compensation to the petitioners for their land comprised in khasra number measuring 20.15 kanals comprised in khasra No. 6, 7 min, 8 min of village Gurha Pattan, tehsil Bhalwal, district Jammu. 02. In the judgment dated 29.05.2023, the writ court came to refer to the matter with respect to the acquisition process being sourced to Jammu and Kashmir Requisitioning and Acquisition of Serial No. 10 2 CCP(S) No. 11/2024 in OWP No. 699/2012 Immovable Property Act, 1968 meaning thereby the acquisition with respect to the land in reference is to be governed by the Requisitioning and Acquisition of Immovable Property Act, 1952. 03. The timeline given in the judgment dated 29.05.2023 having been breached led the petitioners to come up with the present contempt petition filed on 15.01.2024. 04. Today, Ms. Nazia Fazal, Assisting Counsel to Mrs. Monika Kohli, learned Sr. AAG appearing on behalf of the respondent No. 1- Principal Secretary to Government, Revenue Department, Government of India UT of J&K has come forward with a Notification No. 07 JK (Rev) of 2025 dated 06.11.2025 in terms whereof the requisite process leading to the formal acquisition of the land not only of the petitioner’s land but also of land measuring 156.17 kanals which includes the land of the petitioners as well has been set into rolling and the said process is going to reach to its logical end in due course of time. 05. The legal process set into effect obviously entitles the petitioners to register their respective claim for the compensation and, accordingly, it is the final outcome which is going to settle the quantum of compensation payable in favour of the petitioners for their share of the acquired land. 06. Accordingly, this Court reckons that presently this contempt petition needs to be consigned to record on account of compliance having come forward in initiation of the requisite process of law 3 CCP(S) No. 11/2024 in OWP No. 699/2012 which is expected to be carried out to its logical end within a reasonable run of time. 07. This contempt petition is, accordingly, consigned to record with a right reserved in favour of the petitioners to seek revival of the contempt petition in case if the process set into effect for acquisition of the land gets held up without any cause to the prejudice of the petitioners. 08.
