2. The petitioner has preferred this application for grant of regular bail in connection with Kutumba P.S. Case No. 208 of 2024 dated 29.12.2024 registered for the offences punishable u/s 25(1-B) (a), 26 and 35 of the Arms Act.

As per the prosecution case, one pistol, two magazines, five live cartridges and a mobile phone etc. from the possession of the co-accused Suraj Singh, one Katta, a live cartridge and a mobile phone from the possession of the co- accused Rishiraj @ Rishikant and Arjun Singh were recovered separately. It is further alleged that a mobile phone was also recovered from the possession of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner rather the arms were recovered from the possession of the co-accused persons. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 29.12.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above- named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Aurangabad in connection with Kutumba P.S. Case No. 208 of 2024.
7. The application stands allowed.
