HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 33497 of 2025 Court No. - 34 HON'BLE ROHIT RANJAN AGARWAL, J. 1. Private respondents no.6 to 17 were allotted land in question. Father of the petitioner, Shiv Murat Choabey filed an application for cancellation of approval dated 29.12.1990. The said application was dismissed, thereafter, a revision was preferred which was also dismissed. Proceedings for cancellation of patta under Section 122-C (6) stood concluded in the year 1990, and the revision was also decided in the year 2005. 2. Petitioner claims that private respondents have encroached upon PWD road, and are creating hindrance in the nearby plot of petitioner. It is further contended that proceedings under Section 24 of U.P. Revenue Code, 2006 were initiated by one Gulabi Devi w/o Ramaji Chaubey which was concluded by the order passed on 23.09.2021. Petitioner is assailing the orders passed in the year 1990 and 2005 dismissing the application moved by his father for cancellation of allotment made in favour of private respondents. 3. After hearing counsel for the petitioner and perusing the material on record, I find that this writ petition is highly belated, and if the petitioner has any grievance in regard to his plot being interfered by the private respondents, he has a remedy of moving an application under Section 134 of U.P. Revenue Code, 2006 or getting the land demarcated from that of private respondents. 4. No case for interference is made out in the proceedings for cancelling the allotment made in favour of private respondents, which has attained finality by the orders of the year 1990 which stood confirmed in the revision in the year 2005. 5.
