Heard learned counsel for the petitioner, Ms. Anita Kushwaha, Advocate holding brief of Sri Sanjay Kumar Om, learned counsel for the respondent nos.2 to 4 and learned Additional Chief Standing Counsel for the State. 2. By means of present petition, the petitioner has prayed for the following reliefs:- "(i) Issue, a suitable writ order or direction in the nature of mandamus commanding/directing the respondents to forthwith release the security amount deposited by petitioner for work executed under Jal Nigam Scheme for year 2017- 2018 & 2018-2019 with interest as this Hon'ble Court may deem fit and proper. (ii) Issue a writ, order or direction in the nature of Mandamus directing the respondent No. 4 to decide the representation/application dated 03/04.07.2024 (Annexure No. 1)." 3. The grievance of the petitioner is that the respondent- authority is not paying the outstanding amount for the work executed under Jal Nigam Scheme for the year 2017-2018 & 2018-2019. In this regard, the petitioner has made several representations to the respondent- authority, but till date, no action has been taken on the same. 4. Learned counsel for the respondent nos.2 to 4 as well as learned Additional Chief Standing Counsel submitted that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.4 to consider the grievance of the petitioner. 5. Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the present writ petition is disposed off permitting the petitioner to file a fresh representation along with a certified copy of this order raising all his Versus Counsel for Petitioner(s) : Kumar Ankit Srivastava, Mukesh Kumar Counsel for Respondent(s) : C.S.C., Sanjay Kumar Om M/S Kapil Kumar Contractor .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) grievance before the respondent No.4, Executive Engineer, U.P. Jal Nigam (Rural), Meerut within a period of one month from today. In case, any such representation is filed by the petitioner, the respondent no.4 shall consider and decide the same, strictly in accordance with law, by reasoned and speaking order, within a period of two months from the date he receives representation of the petitioner.
