The petitioner has been made accused in connection with Bagodar P.S. Case No. 232/2024, for the offences registered under Sections 64 (2) of the B.N.S. 2023 and Section 6 of the POCSO Act, pending in the Court of learned Special Judge, POCSO Act, Giridih. 3. On 25.12.2024 at about 4: 25 P.M., the petitioner was caught by the informant in naked condition inside his house with nine years’ old daughter of the informant. The victim reported that the petitioner has sexually assaulted her. 4. Learned counsel appearing on behalf of the petitioner submitted that hymen of the victim was found to be intact. It was further submitted that no injury was found on the person of the victim. 5. Considering the fact that the petitioner was found in naked condition in the house of the informant with her daughter, I am not inclined to release the petitioner, on bail.
