IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.2404 of 2025 ------ Anil Kumar Sharma, aged about 26 years, S/o Braj Lal Saraswat, R/o Hemasar, PO & PS Bikaner, District Bikaner, Rajasthan. … … Petitioner Versus The State of Jharkhand. … … Opposite Party ------ CORAM: SRI ANANDA SEN, J. ------ For the Petitioner(s): Mr. Shashank Shekhar No.3, Advocate. For the State : Mr. Naveen Kr. Gaunjhu, A.P.P. ----- 02/ 17.04.2025 Heard the parties.
2. This anticipatory bail application under Sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 316(2)/318(4)/61(2) of the Bharatiya Nyaya Sanhita, 2023 in connection with Doranda PS Case No. 189 of 2024 pending in the Court of learned J.M.F.C XIII, Ranchi.
3. From the materials on record, prima facie I am of the opinion that ther is no apprehension of the petitioner being arrested as notice under Section 41(A) of the Cr.PC corresponding to section 35(3) of BNSS Act has been issued to the petitioner. If that be so the petitioner should appear before the investigating officer within two weeks and get his statement recorded. The issuance of notice under Section 41(A) of the Cr.PC corresponding to Section 35(3) of BNSS Act clearly suggest that there cannot be any apprehension on part of the petitioner that he will be arrested.
