Heard Sri Sudhir Kumar Tripathi, learned counsel for the applicant and Dr. S. B. Maurya, learned AGA-I for the State-respondent are present. 2. The instant application has been filed by the applicant with a prayer to quash the entire proceedings of sessions case No. 804 of 2025 (State of U.P. Vs. Ramjeet and others) arising from case crime No. 513/2018, Police Station Cantt., District Gorakhput, under sections 409, 420, 467, 120B IPC and section 13(2) read with 13(1)(D) of Prevention of Corruption Act, pending in the court of Special Judge, (Prevention of Corruption Act), Court No. 1, Gorakhpur as well as chargesheet No. 1 dated 14.2.2025 and summoning/cognizance order dated 10.3.2025 passed by Additional Sessions Judge/Special Judge (Prevention of Corruption Act), Court No. 1, Gorakhpur in Sessions Case No. 804 of 2025. 3. After some argument, learned counsel for the applicant submitted that the instant application may be dismissed as withdrawn with liberty to the applicant to claim discharge application before the trial court. 4. Learned AGA is having no objection. 5.
