JUSTICE S. B. PD. SINGH ORAL ORDER 3 01-08-2025 Heard learned counsel for the petitioner and learned APP for the State. 2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Muzaffarpur Town P.S. Case no. 503 of 2024 instituted for the offence under Sections 316(2), 318(4), 337, 336(3) and 3(5) of the BNSS. 3. As per allegation in the FIR, petitioner was the then teacher of Madarsa Darul Takmil, Kurban Road Chanwara, had produced a forged letter for the post of prabhari pracharya of the same Madarsa before the informant. Informant became doubtful over the genuineness of the letter. Informant said the petitioner that he will be permitted only after verification of the Patna High Court CR. MISC. No.45141 of 2025(3) dt.01-08-2025 2/3 genuineness of the order upon which the petitioner refused to take charge and then the present FIR. 4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Petitioner is a bonafide teacher of the said Madarsa since 1990. Petitioner is senior to the informant despite, informant had taken charge of prabhari pracharya. The letter which was produced by the petitioner before the informant, was a genuine order of Bihar State Madarsa Board, Patna. Moreover, petitioner is not beneficiary in the present case. Even if, the offence is taken to be true, no offence is made out against the petitioner. Petitioner has got no criminal antecedent. 5. Learned APP appearing for the State has opposed the prayer of Bail. 6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Muzaffarpur Town P.S. Case no. 503 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. Patna High Court CR. MISC. No.45141 of 2025(3) dt.01-08-2025 3/3 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur subject to the conditions as laid down under section 482 of the BNSS. sushma/- (S.
