Mr. Bhuvnesh Joshi, Amicus Curiae for the applicant. Ms. Rangoli Purohit, Brief Holder for the State. Applicant Arpit is in judicial custody in FIR No. 465 of 2022, under Sections 363, 366-A, 376(3), 376(2)(n) IPC and Sections 3, 4(2) and 5(l)/6 of the Protection of Children from Sexual Offences Act, 2012, Police Station Bahadarabad, District Haridwar. He has sought his release on bail.
This is second bail application of the applicant. His first bail application has already been rejected on 08.01.2024. Heard learned counsel for the parties and perused the record. Learned Amicus Curiae submits that the applicant is in custody since 2023; there are 10 witnesses only, but trial has yet not been concluded. Learned State Counsel submits that out of ten witnesses, nine witnesses have already been examined. Having considered, this Court does not see any new ground, which may entitle the applicant to bail. Accordingly, the second bail application deserves to be rejected.
The second bail application is rejected.
