2. The present anticipatory bail application under sections 482 and 484 of Bharatiya Nagrik Suraksha Sanhita, 2023, has been preferred by the petitioner apprehending his arrest for the offences registered under sections 376/504/385/506 of the Indian Penal Code, pending in the Court of learned Judicial Magistrate, 1st Class, Ranchi, in connection with Lalpur P.S. Case No. 21 of 2024.
3. The learned APP opposes the prayer for anticipatory bail.
4. The allegation as per FIR is that the victim who is a major fell in love with the younger brother of the petitioner. They entered into physical relationship and it is alleged that the victim became pregnant. It is further alleged that the mother and sister of this petitioner gave some medicine to the victim and after consuming the same, there was miscarriage. The only allegation against the petitioner is that he along with other co-accused demanded Rs. 5 lakhs in cash in lieu of marriage. The entire allegation of sexual assault is against the younger brother of this petitioner. Further allegation of administration of some medicine which caused miscarriage is upon the sister and mother of this petitioner. The only allegation of demand of money has been levelled against the petitioner.
5. Considering the aforesaid facts, I am inclined to release the petitioner on anticipatory bail. Accordingly, the petitioner, above named, is directed to surrender before the court below within four weeks from today and in the event of his surrender/arrest, the learned court below is

directed to enlarge him on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Ranchi, in connection with Lalpur P.S. Case No. 21 of 2024, subject to the condition that one of the bailers should be close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his/ her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the learned trial court indicating his /her share in the property.
