Petitioner had instituted Kapoor Singh Versus State of Himachal Pradesh & others2, wherein the respondents were directed to decide the representation

preferred by him in accordance with law by passing a speaking and reasoned order. The respondents passed an office order on 18.11.2024 (Annexure P-3), declining to consider the case of the petitioner on the ground that The State of Himachal Pradesh & Ors. Versus Surajmani & Anr.3 was pending adjudication before the Hon’ble Apex Court.

Learned counsel for the petitioner submits that the aforesaid civil appeal stands decided on 06.02.2025. Subsequent thereto, the petitioner again represented to the respondents on 13.02.2025 (Annexure P-5) to decide his previous representation in compliance to the directions issued in Kapoor Singh’s2 case. Petitioner’s grievance is that the respondents till date have not decided his previous representation on merits.

Looking to the limited grievance of the petitioner, this writ petition is disposed with a direction to the respondents/competent authority to consider and decide the representation of the petitioner and the grievances raised by him in the present writ petition in accordance with law, inter alia, taking note of the decision rendered by the Hon’ble Apex Court in the case of

Surajmani3, within a period of two weeks from today. The
order so passed be also communicated to the petitioner.
The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
