(ORAL) CRM-35928-2025 This is an application filed under Rule 3-A(I) Chapter VI Part B, Vol V of the High Court Rules and Orders for grant of leave to file the present petition. For the reasons mentioned in the application, same is allowed as prayed for. Main Case 1. Instant petition under Section 482 of BNSS, 2023 has been filed for grant of anticipatory bail to the petitioner in case FIR No.168 dated 09.07.2020 registered under Sections 379-B, 506 IPC at P.S. Kamboj, District Amritsar (Rural) consequent to the cancellation of bail vide order dated 11.03.2025 (Annexure P-4) and dismissal of anticipatory bail vide order dated 16.05.2025 (Annexure P-5). Learned counsel for the petitioner, inter alia, contends that the petitioner was granted concession of regular bail vide order dated 29.04.2021 passed by this Court (Annexure P-2). Thereafter, the police filed challan and the case was committed to the Sessions Court. He contends that on 11.03.2025 due to an unintentional lapse and loss of track of the hearing date the petitioner could not appear and resultantly, bail of the petitioner was cancelled followed by issuance of non-bailable warrants of arrest. 3. Learned counsel for the petitioner further submits that the petitioner moved an application for anticipatory bail before the learned Sessions Judge, Amritsar which was dismissed on 16.05.2025. 4. Learned counsel for the petitioner inter alia contends that non- appearance of the petitioner was not deliberate or intentional and thus, aggrieved by the said order, he has approached this Court by way of instant petition. 5. It is also submitted that the petitioner undertakes to appear before the trial Court on each and every date. 6. Notice of motion. 7. Mr. Ravinder Singh, DAG Punjab, who is present in Court, accepts notice for the respondent-State and submits that the impugned orders have been passed on the sole ground of the absence of the petitioner. 8. I have heard the learned counsel for the parties and perused the record of the case. 9. The reason assigned by the petitioner for not attending the Court is that he lost track of date of hearing but the same are not sufficient Puneet Sharma 2025.09.09 20:17 I attest to the accuracy and authenticity of this order/judgment 106 CRM-M-50122-2025 (O&M) -3- as he was bound to appear on each and every date without fail. However, taking a lenient view and keeping in view the fact that trial is being delayed due to absence of the petitioner, the bail application is accepted. The petitioner is directed to appear before the learned Trial Court within 15 days from today, and on his appearance, he is ordered to be released on bail on furnishing bail bonds/surety bonds to the satisfaction of the learned Trial Court. 10. This order is subject to payment of costs of Rs.5000/- to be deposited with the “Punjab Chief Minister Relief Fund”, A/c No.001934001000589, IFSC-TPSC0000019, Punjab State Cooperative Bank. 11. In case the petitioner fails to surrender within 15 days, this order shall stand vacated automatically without reference to this Court. 12. The petition stands disposed of accordingly.
