The instant petition has been filed for following relief:- "Issue a writ, order or direction in the nature of mandamus directing the Consolidation Officer, Kasya, District : Kushinagar, respondent no. 2 to decide the Recall Application dated 28.1.2023 in Case No. Kaymi/776 to 778/1216 to 1218 (Suryabhan Vs. Chandravati Devi & Others) relating to Khata No. 120 and 262 situated at village Vijaypur, Tappa Papaur, Pargana Sidhua Jobna, Tehsil Padrauna, District Kushinagar within stipulated period." 3. In compliance of the order of this Court, a report has been submitted by the Consolidation Officer, Kasya, Kushinagar that the next date fixed in the recall application was 13.2.2025 and by further instruction it has been reported to this Court that recall application has been allowed vide orders dated 5.3.2025. 4. Counsel for the petitioners submitted that the recall application has been decided by Consolidation Officer, Kasya, Kushinagar during pendency of the instant petition, as such the writ petition has become infructuous. 5. In view of the statement made by counsel for the petitioners as well as the instructions sent by Consolidation Officer, the instant petition is dismissed as infructuous.
