We formally admit the appeal against the judgment and order dated 20th June, 2025 passed by a learned single judge of this Court in the exercise of his writ jurisdiction. By this judgment and order, the writ petition has been dismissed on the ground of “serious suppression of material facts.”
The case run by the writ petitioners is that on 6th May, 2024; they were duly elected as President and Secretary of the Alokdia VEC. The allegation in the writ petition was that they, as President and Secretary of the Organisation had been wrongfully removed. On 27th November, 2024, an election was held which was approved by the Block Development Serial No. 02 Daily List 2025:MLHC:594-DB
Officer (BDO) on 6th December, 2024. Thus, the reconstituted Alokdia VEC started functioning.
In the affidavit-in-opposition filed before the learned single judge, the State respondents relied on a purported resignation letter dated 24th September, 2024 signed by the writ petitioners by which they had sought discharge from service.
Learned counsel for the appellants, relying on the rejoinder affidavit filed to the affidavit-in-opposition of the State before the learned single judge submits that the said resignation letter had been fabricated by the private respondents and their associates so as to portray to all concerned that the President and Secretary had resigned. The said respondents were forced to withdraw/cancel this letter after an FIR was lodged with the police station by the writ petitioners. After several meetings between the appellants, the said respondents and other stakeholders, the petitioners withdrew the FIR. Hence, the purported resignation letter was non est and did not constitute any material fact.
Since the newly constituted Alokdia VEC is functioning for over six months, we feel that there is no necessity of considering or passing an interim order at this stage.
We propose to hear out the appeal dispensing with all formalities. 2025:MLHC:594-DB
Advocate-on-Record for the appellants shall file an informal paper-book in this Court by 21st July, 2025 serving a copy thereof on the Advocate-on-Record for the respondents at least seven days before the next date of hearing of the appeal.
The application [MC(WA) No. 65 of 2025] is disposed of.
