3. Applicant-accused was convicted for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881. In Criminal Appeal (Criminal Appeal No. 102 of 2024), filed by the applicant, the learned Vth Additional Sessions Judge, Dehradun directed the applicant to deposit twenty percent of the fine amount. The appellant had not deposited the amount, hence, a warrant has been issued against him. Hence, the present Application, under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
4. Heard learned counsel for the parties and perused the record.

Learned counsel for the applicant has submitted that negotiations regarding a settlement are underway with the complainant. Applicant undertakes that he shall deposit the said amount, as directed by the Appellate Court, within ten days’ from today.
6. In the interest of justice, time, as prayed by the applicant, is granted. The effect and operation of the warrant, issued against the applicant, are kept in abeyance until 31.01.2026, unless it is cancelled earlier by the appellate court.
7. The present Application (No. 2282 of 2025), filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is
disposed of accordingly.
