CORAM:

Order No.
ORDER(ORAL) 12.02.2026
03. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is a bail application U/S.483 of the BNSS by the petitioners for grant of bail in connection with Boudh PS Case No. 249 of 2025 corresponding to Special (NDPS) Case No. 102 of 2025 pending in the Court of learned Sessions-cum-Special Judge, Boudh for commission of offences punishable U/Ss.20(b)(ii)(C)/29 of the NDPS Act, on the main allegation of possessing 70Kgs of Contraband Ganja inside the bush of ridge near a pond at Village Rajanpali . 3. Heard, Mr. Krushna Chandra Meher, learned counsel for the Petitioner and Mr. T.K. Acharya, learned Addl. PP in the matter and perused the record. 4. After having considered the rival submissions upon perusal of record, there appears allegation against seven persons for possessing 70Kgs of Contraband
Ganja, but FIR has been registered against eight persons including a lady namely the Petitioner-Sabitri Majhi. In the meantime, charge sheet has already been submitted, but the Petitioner No.1 is a lady and she has been detained in custody since 23.05.2025, however, the Petitioner-Sabitri Majhi is not having any criminal antecedent of similar nature. In the aforesaid facts and circumstance and taking into consideration the nature and gravity of the offence as alleged against the Petitioner No.1 and regard being had to the status of the Petitioner No.1 as a lady and there being no specific antecedent against the Petitioner No.1 Sabitri Majhi, but there being allegedly joint possession of the Contraband article and FIR being registered against eight persons together with the averment of the FIR reveals seven persons for possessing 70Kgs of Contraband Ganja, this Court considers that the conditions of Sec. 37 of NDPS Act may be dispensed with for the Petitioner-Sabitri Majhi only. 5. For the reasons stated hereinabove and the taking into consideration the materials placed on record, but considering the status of the petitioner- Sabitri Majhi, this Court while not being inclined to grant bail to the petitioner No.2 Malaya Behera, considers it proper to admit the petitioner No.1 Sabitri Majhi to bail. 6.
Hence, the bail application of petitioner No.2- Malaya Behera stands rejected, whereas the bail application of the petitioner No.1 namely Sabitri Majhi
is allowed and she is allowed to go on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees One Lakh) with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. 7. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. (G. Satapathy)
