HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 33511 of 2025 Court No. - 34 HON'BLE ROHIT RANJAN AGARWAL, J. 1. This writ petition has been filed with the following prayer:- "I. Issue a writ order or direction in the nature of mandamus directing the respondent no.2 to expeditiously decide the Case No.8812+8813+8814/2023 (Anil versus Nandji and others) U/s 116 of U.P. Revenue Code 2006 with regard to different Mauja i.e. Jamuwa, Ghorwali and Pratappur Khurd within a short time bound period as may be determined by this Hon'ble Court under the facts and circumstances of the case." 2. It is contended that partition suit filed under Section 116 of the U.P. Revenue Code, 2006 is pending consideration which is registered as Cases No.8812 of 2023, 8813 of 2023 and 8814 of 2023 (Anil versus Nandji and others) U/s 116 of U.P. Revenue Code 2006. The sole prayer made in the writ petition is for expeditious disposal of the said case. 3. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the private respondents, the matter is being disposed of, at the admission stage, with a direction upon respondent no.2- Sub Divisional Magistrate, Sadar, Ballia to decide the Cases No.8812 of 2023, 8813 of 2023 and 8814 of 2023 (Anil versus Nandji and others) U/s 116 of U.P. Revenue Code 2006, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of six months from the date of production of certified copy of this order. 4. With the aforesaid direction, present writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the case on merit.
