1. Heard learned counsel for the revisionist, learned counsel for the opposite party Nos. 2 to 8, learned A.G.A. for the State and perused the record. 2. The instant revision has been filed against the order dated 8.8.2024 passed by learned Additional Sessions Judge / Special Judge Dacoiti Affected Area (D.A.A.), Mainpuri in Criminal Misc. (Complaint) No. 33 of 2023 (Madhuri Devi vs. Vedpal and others), under Section 203 Cr.P.C., P.S. Kotwali, District-Mainpuri, by which the application moved by the revisionist under Section 156(3) Cr.P.C. was converted into a complaint and thereafter the statement of victim and two other witnesses under Sections 200 and 202 Cr.P.C. were recorded respectively. 3. Learned counsel for the revisionist has submitted that, despite being sufficient evidence on record, particularly the statement of the victim and other two witnesses, as well as the medical report, the learned Court of Special Judge (D.A.A.), Mainpuri has dismissed the complaint of the revisionist under Section 203 Cr.P.C. He further submitted that, apart from the revisionist and her brother-in-law (jeth) being assaulted and a sum of Rs. 20,000/- (Rs. twenty thousand) was taken away by the assailants / opposite party Nos. 2 to 8 and prayed that the dismissal of complaint under Section 203 is wholly illegal and arbitrary and the order dated 8.8.2024 passed by learned Additional Sessions Judge / Special Judge Dacoiti Affected Area (D.A.A.), Mainpuri is liable to be set aside. 4. vengeance and to pressurize the opposite parties in respect of civil litigation pending between the parties for a long time. He next submitted that the story of incident has been exaggerated, as much as the statement of the victim recorded under Section 200 Cr.P.C. and the statement of other two witnesses recorded under Section 202 Cr.P.C. are totally different and there are material contradictions in narrating the said incident, which has taken place on 27.1.2024.
He further submitted that the order passed by the learned Additional Sessions Judge / Special Judge (D.A.A.), dated 8.8.2024 is in accordance with law and calls for no interference by this Court. 5. After having heard the learned counsel for the parties and perused the impugned order as well as other material on record, this Court finds that there are material contradictions in the statements of victim as well as two other witnesses recorded under Sections 200 and 202 Cr.P.C.; this Court has also taken note of the fact that a civil litigation between the parties is pending for such a long time and in order to wreak vengeance and to pressurize the opposite parties a false story has been concocted by the revisionist. 6. There is no merits in the present revision and the same is accordingly dismissed. October 10, 2025 Faridul CRLR No. 4983 of 2024 2 (Harvir Singh,J.)
