Mr. Saurabh Kumar Pandey, learned counsel for the applicant. 2. Mr. Siddharth Bisht, learned A.G.A. for the State. 3. Present applicant– Digvijay Suyal,S/o Ramesh Chandra is seeking regular bail in relation to first information report dated 15.07.2025 bearing FIR No.0196 of 2025, registered at Police Station ITI, District Udham Singh Nagar, wherein the present applicant along with one Nikesh Chandra have been implicated for the offences punishable under Sections 8/20 read with Section 60 of the NDPS Act. 4. Learned counsel for the applicant submits that the present applicant is innocent and has been falsely implicated and the alleged contraband, which is shown to be recovered from the present applicant is a joint recovery and below the commercial quantity, i.e. 710 gram charas and, furthermore, the applicant is having no previous criminal history. He further submits that co-accused, namely, Nikesh Chandra having similar role has already been granted bail by this Court on 05.08.2025, therefore, the present applicant is entitled for bail on the ground of parity. He further submits that without there being any search the applicant himself prior to search told the police party that he is having contraband which itself reveals that prosecution story appears to be doubtful and there is substantial compliance of mandatory provision of NDPS Act. 6. On the other side, Mr. Siddharth Bisht, learned A.G.A. has not disputed this fact that the contraband which is shown to be 2025:UHC:6967 recovered from the possession of the applicant and co-accused Nikesh Chandra is non commercial quantity and the co- accused Nikesh Chandra has already been enlarged on bail by this Court on 05.08.2025 in BA1 No. 1380 of 2025 and it is a case of parity. 6. Having heard learned counsel for the parties and further taking into consideration that the co-accused Nikesh Chandra having has already been granted bail by this Court on 14.07.2025 and alleged recovered contraband is non- commercial quantity and furthermore applicant has no previous criminal history, therefore, this Court is of the view that the present applicant is also deserve for bail on the ground of parity. 8. Accordingly, without expressing any opinion on the merit of the case, the instant bail application is allowed. 9. Let the applicant, namely, Digvijay Suyal, be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
