The petitioners have moved this Court for grant of bail in connection with Nawa Bazar P.S. Case No.18 of 2023 corresponding to NDPS Case No. 07B/2023 registered for the offences punishable under sections 20/22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and under Section 414/34 of the Indian Penal Code. The learned counsel for the petitioners submits that the allegation against the petitioners is that the petitioners were involved in cultivation of Ganja plant. It is further submitted that the allegations against the petitioner are all false. It is then submitted that only 850 grams of Ganja like substance were found from the said plants which comes under small quantity. It is further submitted that only because the Ganja plants were found near the house of the petitioners, hence they have been implicated in this case. It is next submitted that the petitioners have been in custody since 12.02.2025 and the petitioners have no criminal antecedent as has been mentioned in para –14 of the bail application. It is then submitted that the co-accused person has already been admitted to bail by a co-ordinate Bench of this Court vide order dated 20.07.2023 in B.A. No. 3928 of 2023. It is further submitted that the petitioners undertake to cooperate with the trial of the case. Hence, it is submitted that the petitioners be admitted to bail. The learned Addl. P.P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above-named petitioners on bail. Accordingly, the petitioners are directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge under NDPS Act, Palamau, in connection with Nawa Bazar P.S. Case No.18 of 2023 corresponding to NDPS Case No. 07B/2023 with the condition that the petitioners will co-operate with the trial of the case and will furnish their mobile number and photocopy of the Aadhar Card with an undertaking that they will not change their mobile number during the trial of the case.
