Present petition has been filed under Section 482 of BNSS, 2023 seeking regular bail in case FIR No.126 dated 22.11.2024, under Sections 105 & 61(2) of BNS, 2023, registered at Police Station Joga, District Mansa, Punjab. 2. Learned counsel for the petitioner submits that the FIR has been registered on the basis of doubt and assumptions only naming number of accused, i.e. (1) Hakam Singh, (2) Ginni Singh (petitioner herein), (3) Ghukha Singh, (4) Manjit Kaur, (5) Jaggi Singh, (6) Binder Singh and (7) Bholi Kaur. Deceased in the instant case is Gurpreet Singh @ Baljinder Singh, whose dead body was lying on the passage of old dump yard (Hadda Rori). There is no eye-witness to this account. Further contends that except raising doubt and bald allegation and even there being no motive attributing to the petitioner, he has been implicated in the case and presently he is inside jail since 17.06.2025. Additionally, it is also contended that almost similarly situated co co- AMANDEEP GOSAIN 2025.09.12 17:32 I attest to the accuracy and integrity of this order/judgment CRM-M-50006-2025 - 2- accused namely Hakam Singh and Sukhwinder Singh @ Ghuka and Manjit Kaur have been granted concession of bail by this Court. Counsel refers to the order dated 27.01.2025 (Annexure P-5) passed in CRM-M-4319-2025. Also produces the order dated 15.05.2025 passed in CRM- M-6621-2025 in reference to the anticipatory bail granted to co-accused Hakam Singh. The petitioner, facing similar allegations, seeks bail on the ground of parity, thus, prays for grant of regular bail. 3. On the other hand, learned State counsel submits that the offence is serious one, as the petitioner has an active role in the murder and submits that his release may give chance of misusing of the witnesses whose statements are yet to be recorded. He however does not dispute granting of bail to other co-accused. 4. Considering the submissions addressed by both the sides and the fact that two accused have already been granted bail; this Court is of the considered view that the petitioner deserves a fair opportunity to rehabilitate and reintegrate into society. Without expressing any opinion on the quality or sufficiency of the prosecution’s evidence, and having regard to the petitioner’s prolonged incarceration and the fact that the trial is still at a preliminary stage, with material witnesses yet to be examined, the Court is of the opinion that the petitioner’s personal liberty ought not to be curtailed indefinitely. Consequently, prayer made in the present petition is allowed. Petitioner is ordered to be released on bail, subject to his furnishing bail/surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case. 5.
