According to petitioners, they were appointed as ‘Shiksha Mitra’ in Education Department, against available teaching posts; however, their claim for regular appointment has not been considered, even though they are eligible for appointment. The reliefs sought in the writ petition, are as follows: “(i) issue a writ, order or direction in the nature of mandamus commanding the respondent to absorb the petitioners permanently as Assistant teachers in Education Department at their respective place of posting i.e. Government Primary school where they are provisionally absorbed vide orders dated 13.1.2015. (ii) a writ, order or direction in the nature of mandamus commanding the respondents to provide all service benefit of a permanent Assistant Teacher in Government Primary School since the date the petitioners are working as Shiksha Mitra against the substantial and vacant post.” 3. Since petitioners have sought a writ of mandamus, without making formal demand, therefore the writ petition is disposed of with liberty to petitioners to make representation to District Education Officer concerned. If 2025:UHC:8104 petitioners make such representation within ten days from today, decision thereupon shall be taken by the competent authority within six months thereafter.
