The petitioner has been made accused in connection with S.T. Case No.237 of 2024, arising out of Borio (J) P.S. Case No.299 of 2019, registered for the offences punishable under sections 371, 372, 373 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner was dealing with the minors for prostitution. It is submitted that the allegation against the petitioner is false. It is next submitted that there is no allegation against the petitioner of being involved in prostitution and the complaint was filed after nine years of the alleged occurrence. It is next submitted that during the trial, three witnesses including the informant- PW-1 and victim- PW-2 have been examined and they have not supported the case of the prosecution and they have been declared hostile. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case. It is lastly submitted that the petitioner has been in custody since 15.06.2024 as is evident from para-01 of the instant bail application. Hence it is submitted that the petitioner be released on bail. Learned Addl. P.P. opposes the prayer for bail. Considering the submission of the learned counsel for the parties and considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty-five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Sahibganj, in connection with S.T. Case No.237 of 2024, arising out of Borio(J) P.S. Case No.299 of 2019, subject to the condition that the petitioner will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the Court below with an undertaking that he will not change his mobile number during the trial of the case.
