JUSTICE ANIL KUMAR SINHA ORAL ORDER 2 05-05-2025 1. Heard learned Counsel for the petitioners and learned APP for the State. 2. This application, for grant of anticipatory bail, arises out of Tariyani PS case no. 159 of 2024 dated 30.08.2024, disclosing offences punishable under Sections 316(2), 318(4) of the B.N.S.S. 2023. 3. The prosecution story, as per the First Information Patna High Court CR. MISC. No.24957 of 2025(2) dt.05-05-2025 2/3 Report, is that total quantity of 4,766 quintals of paddy was procured by Pojhiya PACS in the financial year 2023-24. It is alleged that out of the total paddy procured from the farmers, 1,692 quintals of paddy was supplied to the rice mill and 1160 quintals C.M.R. was made available by the PACS to State Food Corporation. However 3074 quintals of paddy having value of Rs. 67,87,392/- was not supplied to the State Food Corporation. Accordingly, the allegation is that the aforesaid amount has been misappropriated by the petitioners. 4. Learned Counsel for the petitioners submits that petitioners have not committed any offence in the manner alleged and have falsely been implicated in this case due to some confusion. Petitioner no. 1 is the Chairman of the PACS, petitioner no. 2 is the Manager and other petitioners are members of the PACS. Learned counsel further submits that the F.I.R. has been lodged on the basis of letter dated 29.08.2024 of Co-operative Extension Officer, Tariyani and subsequently, thereafter, the same officer i.e. the informant, vide his letter dated 18.09.2024 informed the Police that during extended deadline, the petitioners have supplied the balance quantity of paddy to the rice mill. Regard being had to the submissions made on behalf of the parties and taking into consideration the letter dated 18.09.2024 of Co-operative Extension Officer, Tariyani, by which he has informed the Police that entire paddy has been supplied by the petitioners, I am inclined to grant the privilege of anticipatory bail to the petitioners. 6. This application is, accordingly, allowed. 7. Let petitioners, abovenamed, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Tariyani PS case no. 159 of 2024, subject to the condition laid down under Section 482(2) of the Code of Criminal Procedure. rinkee/- (Anil Kumar Sinha, J) U T
