IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH 117 CRWP-9739-2025 Date of Decision: 08.09.2025 FAISAL MOHD …..PETITIONER Vs. STATE OF HARYANA AND OTHERS …..RESPONDENTS CORAM: HON’BLE MR. JUSTICE SUBHAS MEHLA Present: Mr. Nafeesh Ahmed, Advocate for the petitioners. ****** SUBHAS MEHLA, J. (ORAL) 1. The prayer in the instant criminal writ petition filed under Article 226/227 of the Constitution of India is for the issuance of a writ in the nature of habeas corpus for directing respondent Nos. 2 to 4 to release detenue namely Salma wife of the present petitioner from Safe house/Nari Niketan. 2. Learned counsel for the petitioner contends that the detenue is stated to be minor and kept in safe house/Nari Niketan at Tauru, but as per her Aadhar Card and other documents she was major. It is also stated that petitioner approached this Court vide CRM-M-43433-2024 decided on 11.11.2024. 3. There is no reliable document on record which confirms that alleged detenue is major i.e. matriculation certificate or document issued by the Registrar Births and Deaths regarding her age. The authority has already sent her to safe house/Nari Niketan as it prima facie shows that she is a minor. 4. In this eventuality the present petition is disposed of with a direction to the authorities to produce the detenue, who is stated to be minor, before Child Welfare Committe and the concerned authority will take an appropriate decision in accordance with provisions of the Juvenile Justice (Care and PRIYANKA 2025.09.11 10:05 I attest to the accuracy and integrity of this document CRWP-9739-2025 -2- Protection of Children) Act, 2015, in consonance with the directions given by this Court in CRWP-2139-2022 titled P...
