Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Petitioner is aggrieved by the notice issued by the respondents dated 28.7.2024. The ground of challenge to the notice is that such notices are contrary to the orders passed by the Chief Judicial Magistrate dated 2.6.2023. Once that be so, remedy of the petitioner would be to respond to the notice by highlighting such facts and in case any prejudicial order is passed, despite it, only then cause of action will arise to the petitioner. At this stage, we do not find any occasion to interfere with the notice as the petitioner has the remedy to reply to it. The question as to whether order of Chief Judicial Magistrate has been violated by issuing the notice also needs no comment, at this stage, from this Court. Leaving it open for the petitioner to submit reply to the impugned notice, this petition is consigned to records.
