GP FOR REVENUE (AP) 2 HBKM,J W.P.No.6736 of 2020 The Court made the following Order: Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondents in proposing to convert the land of water body i.e., Tank situated in an extent of Ac.8.06 cents in Sy.No.253-3, Kondapalem, Routhalapudi Mandal, East Godavari District for the purpose of allotment of house sites. 3. On the other hand, the learned Assistant Government Pleader relying upon the instructions of the 3rd respondent dated 18.08.2025 submits that initially an extent of Ac.8.06 cents Government land in Sy.No.253/3 of Kondapalem Village of Rowthulapudi Mandal was identified for providing house sites to the eligible families, which is classified as “Government land- Pond” as per the village revenue records. But subsequently, it was found that during the rainy season the pond was filled with water and it is being used for irrigation purpose to the surrounding fields of 50 Acres approximately. 4. In view of the above said situation, the proposal for grant of house sites in Sy.No.253/3 (Govt. land-Pond) of Kondapalem Village has been withdrawn and alternative land in Sy.No.155 to an extent of Ac.14.00 cents of Mallavaram Village of Rowthulapudi Mandal was acquired by the Government and the house site pattas were also distributed to 243 eligible beneficiaries of Mallavaram Village. 3 HBKM,J W.P.No.6736 of 2020 5. In view of the above said facts and circumstances, as the subject land was not used for the purpose of house sites, no cause survives in this writ petition. The written instructions of the 3rd respondent dated 18.08.2025 shall be made as part of the Court record. 6. Accordingly, this Writ Petition is dismissed as infructuous. Interim order, if any, deemed to have been vacated. There shall be no order as to costs.
