1. Instant petition has been filed under Article 226 of the Constitution of India, inter alia, for issuance of a writ in the nature of mandamus directing respondents No.1 to 3 to grant pension to the petitioner in view of notification, dated 12.12.2017, Annexure P-1. 2. Counsel for the petitioner submits that the petitioner participated in Matribasha Satyagrah of Hindi Andolan-1957 and is fully eligible to receive monthly pension as notified by the Government of Haryana vide notification, Annexure P-1. Counsel asserts that the petitioner submitted an application, dated 23.03.2024, Annexure P-2 and submitted that during the Andolan, he remained in detention in Ambala Central Jail for about 4 months. Counsel states that by communication dated 26.06.2024, Annexure P-4, Deputy Superintendent, Central Jail, Ambala intimated that the prison record pertaining to the year 1957 has been destroyed in the flood and vide Annexure P-5, police authorities intimated that petitioner has clean antecedents. Counsel submits that Deputy Commissioner, Panchkula, by letter dated 12.08.2024, informed the petitioner that no evidence has been found regarding his participation in the Satyagrah and in case, he Pooja Saini 2025.09.17 09:51 I attest the integrity and accuracy of this order/judgment

Counsel submits that by request dated 21.08.2024, Annexure P-7, petitioner sent an extract of a book published on Silver Jubilee of Arya Pratinidhi Sabha, Haryana, which mentions the name of the petitioner as one of the participant in the Andolan. Counsel asserts that despite representations, request letter, Annexure P-7 is pending. 3. Issue notice of motion to the respondents. 4. On asking of the Court, Mr. Ravish Kaushik, Addl. A.G. Haryana, accepts notice on behalf of the respondents-State. Given the nature of order proposed to be passed, this Court does not deem it necessary to call upon the respondents to submit a response. 5. Letter Annexure P-7, along with the relevant document has been submitted by the petitioner, which is pending with the Deputy Commissioner Panchkula, for grant of pension under the notification Annexure P-1.
In these circumstances, Deputy Commissioner, Panchkula, respondent No.3 is directed to consider the application on the basis of the material supplied by the petitioner and pass appropriate order thereon within a period of three months from the date of communication of a copy of this
order.
6. It will be open to the Deputy Commissioner, Panchkula, to inquire into the documents or grant personal hearing to the petitioner, if necessary, before passing the order.
7. Petition is disposed of accordingly. 08.09.2025
