GP FOR REVENUE 3 BKM,J W.P.No.6259 of 2021 The Court made the following ORDER: Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue for the respondents. 2. This writ petition was filed questioning the action of the respondents in directing the petitioner to evict from the land to an extent of Ac.1.10 cents in survey No.135/4 of Chintaparthi Village, Valmikipuram (Vayalapad) Mandal, Chittoor District, without following the procedure, while the patta granted to the father of the petitioner is subsisting. 3. On the other hand, the learned Assistant Government Pleader for the respondents, relying upon the counter of the 4th respondent, submits that the subject land situated in survey No.135/4 in an extent of Ac.1.10 cents and survey No.135/6 in an extent Ac.3.30 cents are not assigned patta lands granted in favour of the petitioner’s father. The pattadar passbook and title deed in possession of the petitioner is not genuine and they are fabricated one. The pattadar passbook and title deed was never issued in favour of the petitioner and she is not in possession and enjoyment of the subject land and the said land is covered fully with houses, as the said survey number is reserved and earmarked for the construction of houses. It is a village poramboke, as per the re-survey and settlement in the diaglot of Chinthaparthy Village, 4 BKM,J W.P.No.6259 of 2021 which was undertaken ten decades ago. Under the welfare scheme of the state, 55 house site pattas were granted in the subject land on 25.12.2020. The beneficiaries already started construction in their allotted plots. 4. In view of the above said facts and circumstances, as the subject land is a government land and reserved as village site poramboke which was utilized by the respondents for grant of house site pattas to the beneficiaries and as the petitioner’s documents are not genuine and not issued by the competent authority, the same cannot be considered for any purposes. 5. In the result, the writ petition is dismissed. Interim order, if any, deemed to have been vacated. There shall be no order as to costs.
