HIGH COURT OF JUDICATURE AT ALLAHABAD SPECIAL APPEAL No. - 892 of 2025 Court No. - 21 HON'BLE MANOJ KUMAR GUPTA, J.
HON'BLE SIDDHARTH NANDAN, J.
1. The present intra-court appeal is directed against an order dated 20.8.2025 passed by learned Single Judge, dismissing Writ - A No. 11885 of 2025, filed by the appellant-petitioner, praying for a writ of mandamus commanding respondent no. 2 - General Manager, Indian Ordinance Factories, Kanpur to consider her application dated 11.4.2025 for compassionate appointment on account of death of her father, late Sri Ramesh, a Class IV employee, while in harness on 29.6.1992.
2. Learned Single Judge has dismissed the writ petition observing that the father of the appellant-petitioner died on 19.8.1992 and the application for compassionate appointment was filed by the appellant-petitioner, almost after three decades, on 11.4.2025. As such, it has been observed that the very object of granting compassionate appointment does not exist, as it is only to tide over the immediate financial crisis.
3. Learned counsel for the appellant-petitioner submits that after death of father of the appellant-petitioner, her mother approached the respondents for compassionate appointment. She was given only death cum retiral dues upon filing of succession certificate and not compassionate appointment. As the mother has attained age of superannuation, the appellant applied for the compassionate appointment, but which was not granted.
4. We have gone through the pleadings in the writ petition and we find that no claim was made by the appellant-petitioner for her appointment on compassionate basis after the death of her father. She made claim only on 11.4.2025 and the relief claimed in the writ petition was also for a direction Versus Counsel for Appellant(s) : Alok Kumar Srivastava Counsel for Respondent(s) : A.S.G.I. Laxmi Kumari .....Appellant(s) Union Of India Through Its Secretary, Ministry Of Defense, Indian Ordinance Factory And 2 Others .....Respondent(s)
to the respondents to grant her compassionate appointment in pursuance of the application dated 11.4.2025.
5. We are thus in full agreement with the view taken by learned Single Judge.
6. The appeal lacks merit and is accordingly dismissed.
7. The order has been passed in the presence of Shri Srinath Dwivedi, learned counsel for the respondents. October 9, 2025 Jaideep/- SPLA No. 892 of 2025 2 (Siddharth Nandan,J.) (Manoj Kumar Gupta,J.) Digitally signed by :- JAIDEEP BANERJEE High Court of Judicature at Allahabad
