Neutral Citation No. - 2025:AHC:10843 Court No. - 5 Case :- WRIT - A No. - 831 of 2025 Petitioner :- Kali Charan Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Ajit Dubey,Amit Dubey Counsel for Respondent :- C.S.C.,Suresh Singh Hon'ble Ajay Bhanot,J. Heard Sri Amit Dubey, learned counsel for the petitioner, learned Standing Counsel for the State-respondent No. 1 and Sri Shadab Hussain, learned counsel holding brief of Sri Aditya Bhushan Singhal, learned counsel counsel for the respondents no. 2 to 5. The petitioner claims that he is entitled to benefits of retiral dues like pension along with arrears, gratuity, leave encashment, arrears of dearness allowance and arrears of 6th Pay Commission. He has made a representation in this regard but to no avail. Learned counsel for the respondents submit that the matter requires determination of facts by the competent authority as per law in the first instance. However, they fairly contend that his claim for retiral dues like pension along with arrears, gratuity, leave encashment, arrears of dearness allowance and arrears of 6th Pay Commission is liable to be decided by the competent authority in a reasonable time frame. In light of the aforesaid submissions and without going into the merits of the case, the respondents no. 2- Managing Director, Uttar Pradesh Jal Nigam (Urban), Lucknow is directed to decide the representation of the petitioner regarding retiral dues like pension along with arrears, gratuity, leave encashment, arrears of dearness allowance and arrears of 6th Pay Commission as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of. Order Date :- 22.1.2025 Pravin Digitally signed by :- PRAVIN VERMA High Court of Judicature at Allahabad
