This application has been filed for quashing of the orders dated 01.02.2024 (Annexure-5 series) passed by the learned Civil Judge (Sr. Division)-I, Jamtara in Original Suit No. 31 of 2020, whereby and wherein, application of the defendants under Order VIII Rule 1A(3) of the Code of Civil Procedure was rejected. 3. It was submitted that the defendant at the time of defence evidence, has filed public documents for exhibiting them in evidence, but the learned Trial Court has dismissed his application. 4. Mr. Ashutosh Prasad Joshi, learned counsel has appeared on behalf of the opposite party nos. 1 to 3 / plaintiffs. 5. Considering the entire facts and circumstances of this case and the averments made above, orders dated 01.02.2024 (Annexure-5 series) passed by the learned Civil Judge, (Sr. Division)-I, Jamtara is set aside. Learned Civil Judge, Sr. Division-I, Jamtara shall mark the documents filed on behalf of the 2, defendant in evidence in Original Suit No. 31 of 2020 as exhibit with objection. Learned Trial Court shall pass appropriate order regarding the admissibility of these documents at the time of passing of the judgment. 6 This C.M.P. is allowed with the aforesaid observation.
