The applicants have preferred this first bail application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail as they are is arrested in connection with Crime No. 506/2021 registered at Police Station – Masturi, District Bilaspur (C.G.) for the offence punishable under Sections 294, 506 Part-II, 147, 148, 323/149, 307/149 and 302/149 of the IPC. 4. Allegation against the present applicants is that on the date of incident 2 i.e. on 26.09.2021 at around 8.30 PM, the accused/appellants along with other co-accused persons, with intention to cause injury to complainant Dev Kumari and Khoruram, committed unlawful assembly and in furtherance thereof, committed maarpeet with Dev Kumari by means of club uttering obscene words and assaulted Khoruram on his head with rod, which resulted into his death during the course of treatment. Based on this, offence has been registered against the present applicants and other co-accused persons. 5. Learned counsel for the applicants submits that the applicants are innocent and have been falsely implicated in the crime in question. Learned counsel also submits that the main allegation is against Ajay Bhaskar and the present applicants are behind the bar since 23.10.2024, charge sheet has been filed and there is no likelihood of the case being decided in near future. Learned counsel further submits that other similarly situated co-accused persons have already been granted anticipatory bail by this Court vide order dated 19.12.2024 in MCRCA No. 1437/2024, therefore, the present applicants may also be extended privilege of regular bail on the same set of evidence. 6. Counsel for the State however opposes the application for regular bail. 7. Considering the totality of the facts and circumstances of the case and further considering the order dated 19.12.2024 passed in MCRCA No.1437/2024 granting bail to other co-accused persons, the detention period of the present applicants and that the trial may take some time, without commenting anything on merit of the case, I am inclined to release the applicants on regular bail. 8. Accordingly, the instant bail application is allowed. 9. It is directed that the Applicants shall be released on bail on their executing a personal bond for a sum of Rs.25,000/- - Rs.25,000/- each with one surety of the like amount to the satisfaction of the trial Court for their appearance before the said Court as and when directed.
