Page No.1 of 4 https://www.mhc.tn.gov.in/judis Suo Motu TR.No.10426 of 2025 2.The case in PRC.No.19 of 2009 was taken on the file of Judicial Magistrate No.II, Krishnagiri Taluk, Krishanagiri for the alleged offence under Sections 450, 395, read with 397 read with 394, 342 of IPC and Section 27 of Arms Act. There are totally seven accused in this case. As a matter of fact, A1 and A2 are apprehended and they went into trial and were convicted in S.C.No.174 of 2008. As far as the other accused are concerned, the warrant could not be exeucted. 3.Considering the factual matrix, context of the case, the background of the accused, the reason for absence from her usual place, and the submission that, despite best efforts, the warrant could not be executed and the matter is pending for the past 23 years. In view thereof, this is a case, which requires exercise of extraordinary jurisdiction under Article 226 of Constitution of India and accordingly, the PRC.NO.19 of 2009 shall stand closed. However, with liberty to the prosecution to reopen and conduct the case if there is any clue against the accused and if the accused resurfaces in future.
