----------- 04/Dated: 14th August, 2025
1. Mr. Dilip Kumar Karmakar, learned counsel for the petitioner is present. However, no one appears on behalf of the opposite party/husband, in spite of valid service of notice received by him personally. 2. Heard, learned counsel for the petitioner. 3. Learned counsel for the petitioner has submitted that the present transfer petition has been filed under section 24 of the Code of Civil Procedure for transfer of Original Suit No.100 of 2025 to the court of learned Principal Judge, Family Court, Jamshedpur from the court of learned Principal Judge, Family Court, Bokaro. The Original Suit No.100 of 2025 has been filed by the opposite party against the present petitioner (wife) for dissolution of marriage under section 13(1)(I-a) & (I-b) of Hindu Marriage Act. 4. Learned counsel for the petitioner has submitted that the marriage of the petitioner was solemnized with the opposite party on 15.06.2019 in accordance with Hindu Rites and Customs. 5. It is further submitted that petitioner has filed a maintenance case bearing Original Maintenance Case No.231 of 2023, which is pending in the court of Principal Judge, Family Court, Jamshedpur and the opposite party has already appeared in this case. It is further submitted that petitioner is a housewife having no source of income and she is anyhow maintaining and looking after herself, so she could not bear additional cost of litigation by attending the Court of Family at Bokaro. 6.
Considering the overall aspects of the case and the submission on behalf of the petitioner, I feel inclined, in the ends of justice, to allow the prayer of the petitioner. 7. Accordingly, the proceeding of Original Suit No.100 of 2025, pending before the court of Principal Judge, Family Court, Bokaro is hereby transferred to the court of learned Principal Judge, Family Court, Jamshedpur. 8.
