[2025:JHHC:22100] -1- IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 2411 of 2025 Ajay Singh Baraik, aged about 50 years, S/o Late Jay Mangal Baraik, R/o Ghagra Kugaon, P.O. and p.s.- Ghaghra, District-Gumla. ..... … Petitioner Versus Central Bureau of Investigation, through its Director ..... … Opposite Party -------- CORAM : HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI ------ For the Petitioner : Mr. Viveka Nand Choudhary, Advocate For the CBI : Mr. D.K. Bharti, Spl.P.P. ------ 06/ 06.08.2025 Heard learned counsel for the petitioner and learned Spl.P.P. appearing for the Central Bureau of Investigation (CBI). 2. The petitioner is apprehending his arrest in connection with R.C.-05(A)/2012-AHD-R, registered for the offences under Sections 420, 423, 424, 467, 468, 469, 471, 477-A, 120-B, 109 and 201 of the Indian Penal Code and Section 13(2) read with Sections 13(1)(d) of the Prevention of Corruption Act, pending in the court of learned AJC- XVIII-cum-Special Judge, CBI, Ranchi. 3. Mr. Choudhary, learned counsel appearing for the petitioner submits that the petitioner has not been named in the FIR, however, the learned court differing with the chargesheet has been pleased to take cognizance against the petitioner also. He submits that the petitioner has appeared in the examination conducted by the Jharkhand Public Service Commission in the year 2003. He further submits that the allegation is there against the petitioner that he has been provided 12 more marks by the examiner. He further submits that now the chargesheet has been submitted and in view that the petitioner may kindly be provided the privilege of anticipatory bail. 4. Mr. D.K. Bharti, learned Spl.P.P. appearing for the CBI has [2025:JHHC:22100] -2- opposed the prayer and submits that the allegations are there against the petitioner of obtaining 12 more marks by the examiner, in view that prayer for anticipatory bail may kindly be rejected. 5. Considering that the chargesheet has already been submitted and during the investigation, it appears that the petitioner has co-operated in the investigation that’s why the CBI has not arrested him and further the only allegation against the petitioner is that 12 more marks has been provided to the petitioner by the examiner, I am inclined to provide privilege of anticipatory bail to the petitioner. 6. Accordingly, the petitioner, named above, is hereby directed to surrender before the learned court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned AJC-XVIII-cum-Special Judge, CBI, Ranchi, in connection with R.C.-05(A)/2012-AHD-R, subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
