Mr. Harsh Vardhan Dhanik and Mr. Imran Ali Khan, learned counsel for the applicant. 2. Mr. Sandeep Sharma, learned A.G.A. for the State. 3. The present applicant ‘Shahbaaz’ S/o Iftikaar Beg is praying for bail in relation to First Information Report dated 06.05.2025 bearing FIR No. 61 of 2025 P.S. Pullbhatta, District Udham Singh Nagar, wherein, the present applicant along with Tasleem Khan, Shahid Ali and Bachchan Saifi were implicated for the offences punishable under Sections 127(2), 3(5), 308(5), 309(4), 351(3) of BNS, 2023. 4. It is contended by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and there is no specific allegation against the present applicant in the FIR. He also submits that infact the informant have criminal antecedents of 4 to 5 criminal cases and involved in the activity of Bitcoin Money Funding. He also submits that the applicant has nothing to do with the offence as alleged and no specific role has been assigned and furthermore the chargesheet has already been filed. He further submits that the applicant have no previous criminal history and since the chargesheet has been filed as such there is no need of the custodial interrogation of the present applicant. 5. Apart from this, he submits that the other co-accused Tasleem Khan also enlarged on bail by this court on 21.07.2025. 6. On the other side, learned A.G.A. Mr. Sandeep Sharma have not disputed this fact that the chargesheet has already been filed and one another co-accused Tasleem Khan was already enlarged on bail by this court and furthermore the applicant have no previous criminal history and the informant has a criminal antecedent. 7. After hearing the arguments of learned 2025:UHC:7087 counsel for the parties and further taking into consideration that the chargesheet has been filed and as such there is no need of the custodial interrogation of the present applicant and furthermore the applicant has no previous criminal history and the other co-accused Tasleem Khan has already been enlarged on bail, this court is of the view that the applicant deserves for bail. 8. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed. 9. Let the applicant ‘Shahbaaz’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
