3. The present applicant
“Tanjim Samel Tamang, son of Shri Ghyafe Tamang” is praying for bail in relation to First Information Report dated 07.03.2025 bearing FIR No. 0015 of 2025, Police Station –Kempti District – Tehri Garhwal wherein present applicant has been implicated for the offences punishable under Section 8, 20 of the NDPS Act.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and the contraband, which is shown to be recovered from the present applicant is non commercial quantity i.e. 489 gram of charas and for such recovery there is no independent witness and charge sheet has already been filed on 25.04.2025 and as such, at this juncture, there is no need of custodial interrogation of the applicant. She further submits that applicant has no previous criminal history and is languishing in jail since
07.03.2025.

On the other side, Mr. Sandeep Sharma, learned AGA have not disputed this fact that charge sheet has already been filed and as such, there is no need of custodial interrogation of the applicant and applicant has no previous criminal history and contraband which is shown to be recovered from the present applicant is non commercial quantity.
6. After hearing the arguments of learned counsel for the parties and further taking into
consideration that charge sheet has already been filed, therefore, there is no need of custodial interrogation of the applicant and applicant has no previous criminal history and contraband which is shown to be recovered from the present applicant
2025:UHC:7090 is non commercial quantity, therefore, this Court is of the view that the applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed.
8. Let the applicant “Tanjim Samel Tamang, son of Shri Ghyafe Tamang” be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
