JUSTICE K S HEMALEKHA) The present contempt proceedings is initiated against accused / respondent No.3 and 5 for disobeying the order dated 27.11.2024 passed by the learned Single Judge in W.P.No.201496/2024. 2. The learned Single Judge vide order dated 27.11.2024 passed the following order: “a) Writ petition is allowed. b) Respondent No.3 – Executive Officer, Taluka Panchayat, Sedam is hereby directed to secure all relevant records cited supra and send the same forthwith to respondent No.5 – Accountant General to enable the authority to process the pension papers of the petitioner. c) Respondent No.3 shall resend the file pertaining to petitioner within a period of six weeks from the date of receipt of certified copy of this order. d) From the date of receipt of the pension papers forwarded by respondent No.3, - 4 - HC-KAR NC: 2025:KHC-K:3561-DB CCC No. 200086 of 2025 respondent No.5 shall process the pension papers and settle the same within an outer limit of eight weeks from the date of receipt of file from respondent No.3.” 3. Respondent No.2 – Rajiv Kumar Singh S/o Sudarshan Singh, serving as the Accountant General (A & E), has filed an affidavit stating that the order dated 27.11.2024 passed in W.P.No.201496/2024 is complied with and at paragraphs No.9 and 10, it is stated as under: “9. It is respectfully submitted that the Contempt Petition was served on this Office on 30/06/2025. Further, the then Accountant General had been transferred to another department at Delhi and relieved from this Officer on 08/04/2025. I have taken charge as Accountant General (A & E), Karnataka, Bengaluru and I have perused the order passed by this Hon’ble Court dated 27.11.2024 in W.P.No.201496/2024 (S-RES). 10. It is humbly submitted that the Hon’ble Court in its Order dated 27/11/2024, had directed that: - 5 - HC-KAR NC: 2025:KHC-K:3561-DB CCC No. 200086 of 2025 d) From the date of receipt of the pension papers forwarded by Respondent No.3, Respondent No.5 shall process the pension papers and settle the same within an outer limit of eight weeks from the date of receipt of file from Respondent No.3. It is submitted that the Pension Proposals were received in this Accused Office vide No.TPS/EST/NV/2025-2026/150 dated 15/05/2025. Accordingly, in obedience to the orders passed by this Hon’ble Court, I have issued the authorization on 01.07.2025 reckoning the service of bill collectors as per the directions of this Hon’ble Court within the outer limit of eight weeks, subject to the outcome of the Writ Appeal, if any filed by the State. A copy of the same is herewith produced as ANNEXURE-R2.” 4.
