This anticipatory bail application under Sections 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been preferred by the petitioners apprehending their arrest in connection with Complaint Case No.1686 of 2024, for offences under Sections 47(a) of the Excise Act. The case is presently pending before the Court of learned Judicial Magistrate, 1st Class, Bokaro. 3. It is alleged that 2050 liters of sprit was being transported in a pick-up van bearing Registration No. JH09BH2016. 4. Learned counsel for the petitioners submits that the petitioners are not named in the F.I.R. He submits that the petitioners are not at all concerned with the sprit or with the vehicle and the owner of the vehicle has been granted anticipatory bail. 5. Learned APP opposes the prayer for anticipatory bail and submits that the petitioners fled from the place of occurrence and so far as the petitioner No.1 is concerned, there are four similar cases against him. 6. This is a case where 2050 liters of gallon sprit was being transported for brewing liquor illegally. So as to petitioner No.1 is concerned, there are four criminal cases of similar nature under the Excise Act against the petitioner. The Sessions Judge has already given a liberty to the petitioners to appear before the Court 2025:JHHC:18603 2 concerned and seek regular bail. 7. Considering the aforesaid facts, I am not inclined to grant anticipatory bail to the petitioners, at this stage, the same is dismissed. The petitioners should abide by the direction given by the learned Sessions Judge. (ANANDA SEN, J.) Sandeep. Cp-3
