Heard learned counsel for the petitioner and learned Standing Counsel for State-respondents. 2. The petitioner by means of the present writ petition has assailed the order dated 03.05.2025 passed by the respondent no.7-Deputy Inspector General of Police, Varanasi whereby he has rejected the appeal of the petitioner for grant of character certificate. 3. Challenging the aforesaid order, learned counsel for the petitioner has contended that impugned order has been passed without application of mind and in the teeth of bunch of judgement of this Court leading of which is Writ-C No.718 of 2025 (Anil Kumar Vs. State of U.P. Thru. Addl. Chief Secy. Deptt. Of Home Lko. & Others). Accordingly, it is submitted that impugned order cannot be sustained in law having been passed without application of mind. 4. Per contra, learned Standing Counsel would contend that elaborate reasons have been given by the Appellate Authority while rejecting the appeal of the petitioner. 5. Be that as it may, relevant extract of the impugned order dated 03.05.2025 is being reproduced herein below:- "5-मा० उच्च न्यायालय ्षारा िरट यािचका संख्याः 10166/2025 संदीप यादव बनाम उ०्ऺ० राज्य व 05 अन्य में पािरत आदेश िदनांक 08.04.2025 के अनुपालन में याची संदीप यादव पु्ऴ िनरहु यादव िनवासी ्षाम एवं पोस्ट सौना, तहसील सैदपुर, थाना खानपुर, िजला गाजीपुर Versus Counsel for Petitioner(s) : Anju Pandey, Ayush Kumar Gupta, Mithilesh Kumar Gupta Counsel for Respondent(s) : C.S.C. Sandeep Yadav .....Petitioner(s) State Of U.P. And 6 Others .....Respondent(s) ्षारा ्ऺस्तुत ्ऺाथर्ना प्ऴ िदनांक 21.04.2025 पर पुिलस अधी्षक गाजीपुर ्षारा ्ऺेिषत आख्या के आलोक में सम्यक िवचार िकया गया व याची ्षारा पुिलस अधी्षक गाजीपुर ्षारा पािरत चिर्ऴ सत्यापन/्ऺमाण प्ऴ िनरस्तीकरण आदेश रह करने तथा चिर्ऴ सत्यापन/्ऺमाण प्ऴ िनगर्त करने सम्बन्धी िकये गये अनुरोध स्वीकार िकये जाने योग्य नही पाया गया है के दृि्िगत संदीप यादव पु्ऴ िनरहु यादव िनवासी ्षाम एवं पोस्ट सोना, तहसील सैदपुर, थाना खानपुर, िजला गाजीपुर का ्ऺत्यावेदन एत्द्वारा अस्वीकार िकया जाता है।" 6. From the aforesaid extracted portion of the order impugned, it is evident that the Appellate Authority has failed to consider the appeal of the petitioner in correct perspective inasmuch as the Appellate Authority while rejecting the appeal of the petitioner has not considered the guidelines laid down by this Court in bunch of judgement of this Court leading of which is Writ-C No.718 of 2025. 7. In such view of the fact, the impugned cannot be sustained in law and is accordingly, set aside. 8. The matter is remitted to the respondent no.7-Deputy Inspector General of Police, Varanasi to decide the appeal of the petitioner strictly in accordance with law and in the light of bunch of judgement of this Court leading of which is Writ-C No.718 of 2025 within a period of two weeks from the date of production of certified copy of this order. 9.
