The petitioners have filed the present writ petition under Article 226 of the Constitution of India with a prayer to issue a writ in the nature of Mandamus directing respondents to grant all notional benefits and consequential benefits including seniority and pay at par with their counterparts recruited under the advertisement dated 28.02.2020 (Annexure P-1) to the petitioners also while keeping in view the fact that the delay in appointment of petitioners was due to illegal and arbitrary action of the respondents in considering EWS reservation as horizontal reservation instead of vertical reservation. In fact, the said illegal act was quashed vide order dated 14.10.2024 in CWP-4264 of 2021 titled as “Sikander Singh and others Vs. State of Punjab and others” (Annexure P-4). It has been further prayed that the similar benefit has been granted in CWP 8149 of 2023 titled AMIT RANA 2025.09.09 17:24 I attest to the accuracy and authenticity of this judgement/order CWP 26713 of 2025 -2- as “Rupinder Singh Vs. Punjab State Power Corporation Limited”. A further prayer has been made to grant the petitioners an opportunity of selection of station of their choice as per their merits, which was granted to their counterparts under the same advertisement. 2. Learned counsel for the petitioner contends that the petitioners have also served a legal notice dated 10.07.2025 (Annexure P-9) on respondent No. 1, but no action has been taken on the same. He further submits that at this stage he shall be satisfied in case the appropriate directions are issued by this Court to respondent No. 2 to decide the legal notice dated 10.07.2025 (Annexure P-9) in a time bound manner. 3. Notice of motion. 4. On the asking of the Court, Mr. Swapan Shorey, DAG, Punjab, who is present in the Court, accepts notice on behalf of the official respondents and has no serious objection to the limited prayer made by learned counsel for the petitioners, at this stage. 5. I have heard learned counsel for the parties and perused the record carefully. 6. At this stage, this Court deems it appropriate to issue directions to the respondent No. 2 to decide the legal notice dated 10.07.2025 (Annexure P-9) by passing a speaking and well reasoned order within a period of four months from the date of receipt certified copy of this order. While disposing of the aforesaid legal notice, the respondent No. 2 shall also take into consideration the judgments AMIT RANA 2025.09.09 17:24 I attest to the accuracy and authenticity of this judgement/order CWP 26713 of 2025 -3- passed by this Court in CWP-4264 of 2021 titled as “Sikander Singh and others Vs. In case, the petitioners are found entitled to any consequential benefits, the same shall be released to them forthwith, with some reasonable rate of interest. 8.
