It is contended by the petitioner that the 4th respondent has assigned land in an extent of Ac.1.15 cents in Sy.No.1719/4 of Anandapuram village, Kandakuru Mandal, Prakasam District, and that the petitioner has been in occupation and possession of the same, and has been cultivating the same since the date of allotment. However, on account of issuance of house site pattas in favour of the beneficiaries of the scheme launched by the Government of Andhra Pradesh viz., "Navaratnallu Pedalandariki Illu", the revenue officials have asked the petitioner to vacate the subject land. 4. Today, when the matter is taken up for hearing, the learned Assistant Government Pleader for Revenue has placed on record a copy of the written instructions received from the 4th respondent-Tahsildar, dated 04.11.2024. A perusal of the same reveals that the DKT Patta alleged to have been issued in favor of the petitioner is not traceable in the records, and that the petitioner's name is also not recorded as a pattadar in the revenue records with respect to the subject land. It is further stated that the subject land is not proposed for issuance of house site pattas, as it is found in the list of prohibited properties under Section 22-A(1)(b) of the Registration Act, 1908. 5. Having regard to the contentions advanced, in the circumstances of the case, this Court is of the considered view that any action proposed against the petitioner shall be only after issuing notice to the petitioner and affording him a due opportunity to present his case. Till passing of such order, the petitioner shall not be dispossessed of the subject land. 6. The written instructions of the 4th respondent-Tahsildar, dated 04.11.2024 are placed on record. 7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
